Senators charge Department of Education with ignoring the law

Washington, D.C. – Less than a year ago, Congress passed a historic education bill known as the Every Student Succeeds Act (ESSA). That bill took educational control away from the federal government and gave it back to the states. Congress passed it with overwhelming bipartisan support, but a group of senators believe the Department of Education is actively ignoring the law as written.

Recently U.S. Senator Mike Enzi, R-Wyo., joined the Chairman of the U.S. Senate Committee on Health, Education, Labor and Pensions, Senator Lamar Alexander, R-Tenn., along with other senators and house members, in sending a letter to the Department of Education explaining how proposed regulations explicitly ignore the clear and unambiguous intent of Congress.

"It is unfortunate that, once again, the Department has refused to adhere to the letter and intent of the law, or listen to the many stakeholders who helped shape ESSA, are responsible for implementing the new law, and have already articulated the problems this (rule) would create. Congress will do everything in its power to ensure that this proposed rule never becomes final," the senators wrote.

The new rule from the Department of Education would mandate, direct and control how state and local funding is allocated, violating prohibitions placed on the Department of Education in the ESSA.
