Wyoming Congressional Delegation praises repeal of Affordable Care Act 1099 Mandate

Wyoming Senators Mike Enzi and John Barrasso, and U.S. Representative Cynthia Lummis, issued statements regarding today’s (Tuesday, April 5th) action to repeal the "1099" section of President Obama’s Affordable Health Care Act. This provision requires business owners to submit individual 1099 reporting forms for each business-to-business transaction of more than $600 a year. Below are the legislator’s statements.

Enzi praises repeal of 1099 IRS reporting requirement
Washington, D.C. – U.S. Senator Mike Enzi, R-Wyo., Ranking Member on the Senate Health, Education, Labor and Pensions (HELP) Committee, today praised Senate action to eliminate burdensome IRS reporting requirements for small businesses. The repeal passed today is identical to a bill sponsored by Senator Mike Johanns, R-Neb., and cosponsored by Senator Enzi, that would repeal the 1099 mandate approved as part of the new health care law, the Affordable Care Act.

"I am pleased to see that my colleagues in the majority have finally embraced the need to repeal this burdensome provision," said Senator Enzi. "I have long understood that the 1099 requirements kill jobs and hurt small businesses and I commend Senator Johanns for his leadership on this issue."

Business groups across the country have called on Congress to make the changes to the 1099 reporting requirements.

"It is my hope that today’s vote to repeal onerous requirements from the health care law passed last year is the first of many," Enzi said. "This health care spending law is bad for Americans, bad for small businesses, and bad for our economy."

A provision in the Affordable Care Act would force 40 million businesses to submit a separate 1099 form to the IRS for every business-to-business transaction that totals more than $600 in a year. The bill, H.R. 4, passed today rescinds that provision. The bill is now headed to the President’s desk for his signature.

Barrasso praises repeal of Obamacare’s 1099 mandate
‘Washington took action to repeal one of the most absurd provisions of the President’s new law.’

WASHINGTON, D.C. - Today, U.S. Senator John Barrasso (R-WY) delivered the following statement after the Senate voted to repeal the "1099" section of the President’s health spending law. This provision requires business owners to submit individual 1099 reporting forms for each business-to-business transaction of more than $600 a year.

"Small businesses across our country have been completely overwhelmed by Obamacare’s expensive and irrational mandates. Today, Washington took action to repeal one of the most absurd provisions of the President’s new law. Because of Senator Johanns’ (R-NE) leadership, small businesses will no longer have to fill out endless 1099 forms for minor business purchases. America’s job creators won today.

"We will continue to fight to entirely repeal and replace Obamacare. We are committed to breaking down more barriers that prevent Americans from getting the care they need, from the doctor they want, at a price they can afford."

Lummis applauds Congressional passage of 1099 repeal
WASHINGTON, D.C. – Today, U.S. Representative Cynthia Lummis (R-Wyo.) applauded congressional passage of H.R. 4, the House-passed repeal of the burdensome 1099 tax reporting mandate included within ObamaCare.

Lummis released the following statement:

"Today’s bipartisan effort to repeal the misguided 1099 reporting provision is a victory for America’s small businesses. The last thing our country’s job creators need is a mountain of unnecessary paperwork. I look forward to President Obama’s quick action on signing this legislation into law and will continue to fight to fully repeal the misguided health care law and replace it with common-sense solutions."

Background:
• Lummis voted for H.R. 4, repeal of the 1099 mandate on March 30, 2011.

• Under ObamaCare, the 1099 mandate expanded tax information reporting regulations by requiring businesses to issue a 1099 form for any payments to corporations, or property payments that exceed $600 per year, per payee.

• According to the National Federation of Independent Businesses, at $74 an hour, tax paperwork is the most expensive paperwork burden placed on small businesses by the federal government.

• On January 19, 2011, the first vote of the 112th Congress, Lummis voted to repeal ObamaCare.
